Character mistake: A lawyer in an American court will object to part of a witness' testimony and when the judge sustains it, the lawyer does not move for the objectionable testimony to be stricken from the record. In real life, if a judge sustains a lawyer's objection to a testimony, the lawyer will request the testimony be stricken from the record, otherwise it will be fair game for the opposing counsel to refer back to that testimony later in the trial.

Continuity mistake: When Forge is first shown standing in front of the tube containing Wolverine's skeleton, the skeleton is incorrectly shown to be around 7 feet tall (Wolverine is only 5'3"). A couple of shots later, the skeleton is now shown to be more accurately sized. (00:05:19)

Continuity mistake: Throughout the episode, Bishop's goatee alternates between fully covering his chin and having a small spot of exposed skin beneath the soul patch. Sometimes there is even the outline drawn of the exposed skin beneath the soul patch, but it is colored the same as the goatee. (00:05:10 - 00:20:05)

Continuity mistake: When Bishop is trying to disperse the mob, the circular patches on his shoulders are red with yellow borders, and a thin circle design is within the red circle itself. Moments later when he throws Wolverine off himself, the red circles are now blank, and their borders are black instead of yellow. (00:11:00 - 00:11:50)

Continuity mistake: When Bishop is shown returning to his original timeline, he is wearing the temporal band on his right arm. However, when he was sent back to his timeline at the end of the episode Days of Future Past: Part 2, he was not wearing the band because Rogue tore it off his arm and crushed it, which is what caused him to be sent back in the first place. Continuity mistake: When Beast is saying that the virus was genetically engineered, the chin area of Bishop's black goatee is the same color as his skin. (00:13:01)

Continuity mistake: When Moira and Banshee are alerted to Xavier in distress, the building with his room is several yards away from the edge of the cliff. However, when Banshee dives to save Xavier from falling to his death, the edge of the cliff is now only a few feet from the building. (00:02:46 - 00:05:02)

Continuity mistake: When Moira and Banshee's kiss is interrupted by Xavier's scream, his room is directly behind them. Moments later when Moira and Banshee are running to his room, it has moved significantly to the left of where they were just kissing. (00:02:44)

Continuity mistake: When Moira is telling Banshee that Xavier has given everything for his students, she has her left hand placed on Banshee's right arm, and her right arm is down at her side. Then when she remarks that she thinks she's the only friend Xavier has, she is running her fingers through her hair. When this scene was shown in the previous episode however, she is grasping Banshee's arm with both of her hands, and she never runs her fingers through her hair. (00:02:26)
