Factual error: After the boat has blown up and sunk, Ben swims over to it and checks it out, very little to anything is even a little charred, with that big of an explosion everything would be burnt, and black.
Factual error: In the beginning of the movie after Tess' divorce and she wants to pursue Nigel to weigh anchor she says that it doesn't make sense to wait at Key West for the helicopter with Gemma. However in the background there are islands with quite high hills visible. The highest elevation in the whole Florida Keys (where Key West belongs to) is 18 feet. (00:27:25)
Continuity mistake: After the divorce has been made final and Tess and Ben are outside, you can see that Ben's shirt has gotten considerably dryer than in the previous shot without a reasonable amount of time for it to have done so.
Factual error: Toward the end when the speedboats steer toward Ben, if you look at his hair you can see that part of it is dry even though he just came up from under the water.
Plot hole: When Finnegan is in the water and the explosive charges go off, Finnegan should be dead from concussion, and the explosives are big enough to have caused his death by them flinging him quite high out of the water. What happened to Finnegan was pure fantasy.
Continuity mistake: When the speed boat comes up in the water towards Bunny's plane, 1 shotgun blast is fired causing a spread of holes in the plane. In a shot where Bunny is standing on the plane's pontoon there are now two separate hole patterns.
Continuity mistake: When Tess realizes that Ben is on the boat as she's serving dinner, she bends forward to toss the first plate twice. (00:38:40)
Factual error: When the 206 crashes towards the end of the movie, you can see the prop still spinning under the water. In reality the engine would have stopped and compression would not have allowed this to happen. Also the blades would have been bent and not broken off as you only see two.
Continuity mistake: When Gemma is going into town to go shopping, as the speedboat first drives off the flag is blowing toward the boat's stern, but when she is in the boat the flag behind her is blowing toward the starboard side of the boat, and now with the flag still blowing toward the starboard side the wind blows her hat off to the stern.
