Factual error: Russell said he served twenty-one years in prison because his last offense - possession of 30 grams of marijuana with the intent to distribute - counted as his "third strike" under California's "Three Strikes And You're Out" statute. When he was on the internet trying to locate his father (instead finding his obituary from 2001), information on the computer indicated it was now 2012. This would mean Russell was incarcerated since 1991 - and further indicates he was sentenced about three years BEFORE California's "Three Strikes And You're Out" statute was implemented. Also, 30g of marijuana is the limit for "personal use", so he wouldn't have been charged with intent to distribute. (00:16:15)

Deliberate mistake: The prisoners in the dark dungeon would not be able to read the letter (to Miss Dudley from Jason Flemyng that the carrier pigeon had) or see such a clear reflection by pouring water on the stone floor and holding the letter (written backwards) by the water. The room was suddenly lighter when doing so, but it wasn't clear where the light was coming from. Also, sunlight coming through the small window would not beam straight down along the wall. Continuity mistake: At the beginning of the movie, the waitress notices that Emilio for the first time in years has not completed his Sudoku yet. The sequence begins with her stopping by him and waving her hand, upturned, but the hand is then on his shoulder. She repeats the gesture at the cut. (00:01:50)

Continuity mistake: The front view of Sheriff Garrett [Ethan Hawke] while he is talking to Billy shows a stone-walled well between him and the cabin door, but there's no well visible in the rear view. When Billy walks out with his hands up, there appears to be a well to his right (where the horse rail should be visible), but there is no well when Sara and Rio exit the cabin. (00:14:04 - 00:15:10)

Continuity mistake: The way Linda holds her coffee cup changes numerous times, often instantly with front versus rear views. The handle switches (changes 90° or 180°) from facing towards her chest to her left knee to opposite her chest while holding the cup between her bent knees, which vary in distance apart. At the next cut, they are walking down the same boardwalk as Ellen and Joe and in the opposite direction. (00:04:30)

Other mistake: The Burglar (while tied to a chair and talking about "My Darling Clementine") says, "Apex of Ford's art, you feel me?" Vikar (James Franco) responds, "I feel you." The movie starts in 1969, but rapper E-40 (Earl Tyrone Stevens, Sr.) - "slang master" - supposedly created the expression "you feel me" in the early 1990s. (00:19:53)

Revealing mistake: Although the background scenery in the basement (behind the judge and Ron) changes with camera views, what is shown rarely (if ever) corresponds to the correct size and angle/location that would be expected. For example, the file cabinet in the corner behind Judge Straight shows up in different places, some very close to him and others at a distance; its size is not proportionate. Sometimes, the brick wall is directly behind the judge but to the right (of the screen) at other times. (00:03:28 - 00:11:29)
